inputText=%3Cp%3EThe%20lack%20of%20access%20to%20justice%20for%20native%20Irish%20speakers%20in%20the%20Irish%20courts%20system%3C/p%3E%3Cp%3EThe%20International%20Covenant%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20%28ICESCR%29%20is%20an%20international%20human%20rights%20instrument%20that%20identifies%20specific%20economic%2C%20social%20and%20cultural%20rights%20that%20States%20have%20a%20duty%20to%20protect.%20Ireland%20signed%20and%20ratified%20the%C2%A0International%20Covenant%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20%28ICESCR%29%20in%201989.%3C/p%3E%3Cp%3E%3Cb%3EIrish%20Language%20Rights%20and%20the%20Law%20%3C/b%3E%3C/p%3E%3Cp%3ELanguage%20rights%20come%20under%20the%20remit%20of%20Article%2015%20of%20the%20International%20Covenant%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20%28ICESCR%29.%20Article%2015%20covers%20cultural%20rights%2C%20and%20provides%20that%20the%20State%20%3Ca%20href%3D%22http%3A//www.ohchr.org/EN/ProfessionalInterest/Pages/CESCR.aspx%22%3Emust%20take%20all%20necessary%20steps%20for%20%E2%80%9Cthe%20conservation%2C%20the%20development%20and%20the%20diffusion%E2%80%9D%20of%20culture%3C/a%3E.%20The%20main%20suggestions%20put%20forward%20in%20the%20civil%20society%20%3Ca%20href%3D%22http%3A//www.ourvoiceourrights.ie/%22%3EParallel%20Report%20%3C/a%3Eon%20ICESCR%20are%20as%20follows%3B%3C/p%3E%3Cul%3E%3Cli%3EEnsure%20Irish%20speakers%20can%20avail%20of%20their%20constitutional%20and%20statutory%20rights%20to%20access%20services%20in%20the%20Irish%20language%3B%3C/li%3E%3Cli%3EConsider%20and%20adopt%20a%20Community%20Culture%20Strategy%3B%3C/li%3E%3Cli%3EAdequately%20resource%20the%20Irish%20Language%20Commissioners%20Office.%3C/li%3E%3C/ul%3E%3Cp%3EConstitutional%20rights%20to%20access%20services%20through%20the%20Irish%20language%20come%20from%20Article%208%20of%20%3Ca%20href%3D%22http%3A//www.irishstatutebook.ie/en/constitution/%22%3EBunreacht%20na%20h%C3%89ireann%201937%3C/a%3E%2C%20which%20states%20Irish%20is%20the%20national%20language%20and%20also%20the%20first%20official%20language%20of%20the%20State%2C%20accepting%20English%20as%20the%20second%20official%20language.%20It%20is%20from%20the%20%3Ca%20href%3D%22http%3A//www.irishstatutebook.ie/2003/en/act/pub/0032/%22%3EOfficial%20Languages%20Act%202003%3C/a%3E%20that%20statutory%20language%20rights%20derive.%20This%20act%20is%20currently%20being%20amended.%20According%20to%20Section%208%20of%20the%20Act%2C%20it%20is%20the%20right%20of%20all%20citizens%20to%20use%20Irish%20in%20all%20dealings%20they%20may%20have%20with%20the%20courts.%3C/p%3E%3Cp%3E%3Cb%3EIrish-Speaking%20Juries%3C/b%3E%3C/p%3E%3Cp%3EIt%20cannot%20be%20denied%20that%20access%20to%20justice%20is%20a%20fundamental%20right%20in%20any%20society%20governed%20by%20the%20rule%20of%20law.%20However%2C%20for%20historical%2C%20political%20and%20cultural%20reasons%2C%20native%20Irish%20speakers%20face%20major%20difficulties%20when%20they%20attempt%20to%20access%20justice%20through%20the%20medium%20of%20Irish.%20This%20is%20despite%20legal%20protection%20afforded%20to%20the%20Irish%20language%20on%20both%20national%20and%20international%20levels.%3C/p%3E%3Cp%3EIn%202014%20the%20Supreme%20Court%20released%20the%20decision%20of%20%3Ci%3E%C3%93%20Maic%C3%ADn%20%28%C3%93%20Maic%C3%ADn%20v%20Ireland%2C%20The%20Attorney%20General%2C%20The%20Minister%20for%20Justice%20Equality%20and%20Law%20Reform%2C%20His%20Honour%20Raymond%20Groarke%20and%20the%20Director%20of%20Public%20Prosecutions%3C/i%3E%20%5B2014%5D%20IESC%2012%29%2C%20after%20an%20appeal%20from%20the%20High%20Court.%20The%20Supreme%20Court%20affirmed%20the%202010%20High%20Court%20decision%2C%20to%20the%20dismay%20of%20the%20Irish-speaking%20community.%20The%20question%20being%20examined%20at%20court%20was%20whether%20or%20not%20Mr%20%C3%93%20Maic%C3%ADn%20had%20a%20constitutional%20right%20to%20have%20his%20trial%20ran%20through%20Irish%20without%20the%20help%20of%20interpreters.%3C/p%3E%3Cp%3EThe%20alleged%20assault%20for%20which%20Mr%20%C3%93%20Maic%C3%ADn%20was%20charged%20took%20place%20in%20the%20Connemara%20Gaeltacht.%20Mr%20%C3%93%20Maic%C3%ADn%2C%20the%20alleged%20victim%20and%20the%20majority%20of%20the%20witnesses%20are%20native%20Irish%20speakers.%20The%20court%20did%20not%20grant%20Mr%20%C3%93%20Maic%C3%ADn%20a%20trial%20in%20Irish%20on%20the%20basis%20that%20a%20bilingual%20jury%20would%20not%20be%20representative%20of%20the%20community%20as%20a%20whole%2C%20relying%20on%20the%20decision%20in%20%3Ci%3Ede%20B%C3%BArca%3C/i%3E%2C%20%28%3Ci%3EDe%20B%C3%BArca%20v%20Attorney%20General%3C/i%3E%20%5B1976%5D%20I.R.%2038%2C%20a%20case%20on%20the%20exclusion%20of%20women%20from%20juries%29.%20The%20court%20did%20admit%20that%20the%20right%20to%20conduct%20one%E2%80%99s%20official%20business%20with%20the%20State%20did%20exist%2C%20but%20that%20that%20right%20was%20not%20absolute.%3C/p%3E%3Cp%3EJudge%20Hardiman%20said%2C%20in%20his%20dissenting%20judgment%2C%20that%20Ireland%20most%20c inputText=%3Cp%3EWhile%20there%20is%20no%20specific%20right%20to%20access%20justice%20in%20the%20International%20Covenant%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20%28ICESCR%29%2C%20without%20it%20the%20ability%20to%20enforce%20rights%20becomes%20meaningless.%3C/p%3E%3Cp%3EThe%20%3Ca%20title%3D%22link%20to%20OP%20Protocol%22%20href%3D%22http%3A//www.ohchr.org/EN/ProfessionalInterest/Pages/OPCESCR.aspx%22%20target%3D%22_blank%22%3EOptional%20Protocol%20to%20ICESCR%20%3C/a%3Eprovides%20individuals%20with%20a%20complaints%20mechanism%20under%20the%20%3Ca%20title%3D%22link%20to%20CESCR%20site%22%20href%3D%22http%3A//www.ohchr.org/en/hrbodies/cescr/pages/cescrindex.aspx%22%20target%3D%22_blank%22%3ECommittee%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%3C/a%3E.%20However%2C%20like%20the%20Committee%20Against%20Torture%20and%20the%20Human%20Rights%20Committee%2C%20while%20their%20decisions%20are%20persuasive%20as%20they%20can%20censure%20the%20governments%2C%20they%20are%20not%20binding%20and%20they%20cannot%20force%20the%20state%20to%20comply%20with%20the%20Treaty.%3C/p%3E%3Cp%3E%C2%A0The%3Ca%20title%3D%22link%20to%20ICCPR%20site%22%20href%3D%22http%3A//www.ohchr.org/en/professionalinterest/pages/ccpr.aspx%22%20target%3D%22_blank%22%3E%20ICCPR%20%28International%20Covenant%20on%20Civil%20and%20Political%20Rights%29%3C/a%3E%2C%20the%20parallel%20agreement%20to%20ICESCR%2C%20requires%20that%20States%20must%20provide%20an%20effective%20remedy%20to%20the%20violation%20of%20rights%20and%20freedoms.%20Article%202%283%29%28b%29%20then%20specifies%20that%20this%20remedy%20should%20preferably%20be%20judicial.%3C/p%3E%3Cp%3EThe%20courts%20are%20one%20avenue%20for%20the%20enforcement%20of%20rights%20where%20a%20country%20enjoys%20rule%20of%20law.%20Courts%20are%20seen%20as%20independent%20and%20objective%20arbiters%20compared%20to%20governments%20and%20other%20State%20bodies%20who%20might%20otherwise%20adjudicate.%20They%20consider%20not%20only%20national%20sources%20of%20law%2C%20but%20international%20treaties%20and%20norms.%20They%20also%20have%20the%20ability%20to%20enforce%20their%20decisions%20and%20make%20the%20Government%20accountable.%3C/p%3E%3Cp%3EFor%20this%20right%20of%20access%20to%20justice%20to%20exist%20in%20any%20meaningful%20sense%20there%20is%20a%20requirement%20that%20its%20access%20not%20be%20prevented%20by%20a%20monetary%20threshold%20that%20is%20too%20high%20for%20the%20average%20person%20to%20access.%20Ideally%20economic%20status%20should%20not%20be%20a%20consideration%20at%20all.%3C/p%3E%3Cp%3EHowever%2C%20access%20to%20courts%20is%20not%20cheap%20or%20simple.%20Legal%20representation%20can%20be%20incredibly%20expensive.%20If%20a%20person%20cannot%20afford%20to%20hire%20legal%20representation%2C%20but%20can%20still%20technically%20bring%20the%20case%20him%20or%20herself%2C%20the%20issue%20of%20access%20to%20justice%20is%20still%20central.%20The%20court%20system%20can%20be%20hugely%20intimidating.%20Trying%20to%20figure%20out%20how%20to%20get%20a%20case%20off%20the%20ground%20in%20the%20first%20instance%20can%20seem%20like%20a%20mammoth%20task%20all%20by%20itself%20before%20the%20legal%20process%20even%20really%20begins.%3C/p%3E%3Cp%3EThen%20the%20litigant%20is%20required%20to%20file%20certain%20types%20of%20evidence%2C%20to%20submit%20arguments%20based%20on%20legal%20precedent%20and%20know%20what%20relief%20they%20are%20seeking.%20Even%20small%20things%20like%20knowing%20what%20to%20call%20the%20judge%20and%20when%20to%20stand%20or%20sit%20make%20a%20big%20difference.%20Fundamentally%2C%20our%20legal%20system%20fails%20to%20cater%20for%20those%20who%20do%20not%20have%20the%20benefit%20of%20legal%20training.%3C/p%3E%3Cp%3EAccess%20to%20justice%2C%20rather%20than%20mere%20access%20to%20the%20courts%2C%20therefore%20seems%20to%20be%20a%20right%20only%20enjoyed%20by%20the%20wealthy.%20This%20has%20important%20implications%20for%20the%20relationship%20between%20rights%20and%20poverty.%3C/p%3E%3Cp%3EAccess%20to%20justice%20has%20to%20be%20free%20from%20any%20wealth-based%20considerations%20because%20all%20other%20rights%20are%20contingent%20on%20the%20ability%20of%20the%20individual%20to%20uphold%20and%20enforce%20their%20rights%20through%20the%20justice%20system%20if%20necessary.%20You%20need%20to%20be%20able%20to%20find%20redress%20for%20discrimination%2C%20to%20challenge%20unfair%20work%20practices%20and%20to%20ensure%20that%20any%20assistance%20provided%20by%20the%20State%20such%20as%20education%20or%20social%20welfare%20is%20not%20unfairly%20denied%20to%20you.%20Access%20to%20justice%20becomes%20imperative%20in%20order%20to%20access%20all%20of%20your%20other%20rights.%3C/p%3E%3Cp%3EAn%20example%20of%20Ireland%20failing%20to%20uphold%20an%20ICESCR%20right%20concerns%20Article%209%2C%20the%20right%20to%20social%20security.%20While%20Ireland%20has%20a%20civil%20legal%20aid%20system%2C%20there%20are%20some%20specific%20exclusion%20areas%20of%20law%20or%20fora%20where%20it%20cannot%20be%20accessed.%20Currently%2C%20you%20will%20not%20receive%20civil%20legal%20aid%20for%20most%20tribunals%2C%20including%20the%20Social%20Welfare%20Appeals%20Office.%20Cases%20before%20this%20office%20often%20concern%20complicated%20points%20of%20law%2C%20such%20as%20the%20application%20of%20the%20habitual%20residence%20condition%2C%20and%20the%20avenues%20to%20appeal%20are%20unclear%20and%20difficult%20to%20understand.%20One%20TD%20recently%20described%20the%20social%20welfare%20appeal%20system%20as%20a%20%E2%80%98spider%E2%80%99s%20web%E2%80%99%20while%20holding%20up%20a%20complex%20diagram%20of%20the%20different%20routes%20of%20appeal.%20Even%20though%20a%20semi-judicial%20body%20has%20been%20set%20up%2C%20the%20lack%20of%20access%20to%20legal%20representation%20for%20many%20does%20prevent%20people%20from%20accessing%20social%20security.%3C/p%3E%3Cp%3EOf%20course%2C%20in%20an%20ideal%20world%20we%20would%20not%20need%20to%20go%20to%20the%20courts.%20The%20Government%20would%20never%20incorrectly%20deny%20someone%20social%20welfare.%20There%20would%20never%20be%20discrimination.%20Everyone%20would%20have%20perfect%20access%20to%20education%20and%20health%20services.%20Working%20conditions%20would%20always%20be%20fair%20and%20equitable.%20We%20would%20all%20enjoy%20and%20adequate%20standard%20of%20living.%3C/p%3E%3Cp%3EUnfortunately%20even%20with%20good%20intentions%20and%20the%20will%20to%20realise%20these%20rights%2C%20there%20are%20still%20situations%20where%20a%20person%20may%20be%20denied%20them.%20This%20is%20why%20civil%20legal%20aid%20is%20so%20critical%20in%20any%20society%20which%20professes%20to%20take%20rights%20seriously.%20And%20to%20enforce%20the%20fundamental%20rights%20provided%20for%20under%20the%20Covenant%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20%E2%80%93%20rights%20to%20which%20our%20state%20has%20committed%20itself%20to%20respect%2C%20protect%20and%20promote%20-%20access%20to%20civil%20legal%20aid%20is%20vital.%3C/p%3E%3Cp%3E%C2%A0%3C/p%3E%3Cp%3E%3Ci%3ELiz%20O%E2%80%99Malley%20is%20Legal%20Aid%20Intern%20in%20FLAC.%20Her%20personal%20blog%3C/i%3E%3Ci%20style%3D%22line-height%3A%201.5em%3B%22%3E%C2%A0on%20access%20to%20justice%20and%20politics%20is%20at%20%3Ca%20title%3D%22link%20to%20Liz%27s%20blog%22%20href%3D%22http%3A//www.lizomalley.com%22%20target%3D%22_blank%22%3Elizomalley.com%3C/a%3E%3C/i%3E%3C/p%3E]

inputText=%3Cp%3E%3Cb%3EA%20life%20of%20dignity%3A%20Why%20the%20UN%20has%2028%20questions%20for%20the%20Irish%20government%20%3C/b%3E%3C/p%3E%3Cp%3EThe%20issues%20of%20water%20privatisation%20and%20how%20to%20prevent%20abuse%20of%20disabled%20people%20in%20residential%20care%20are%20on%20the%20national%20news%20agenda%20this%20week.%20However%20these%20issues%20are%20also%20on%20the%20international%20agenda%20as%20they%20feature%20among%2028%20questions%20put%20by%20the%20UN%20Committee%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20to%20the%20Irish%20Government%20this%20week.%3C/p%3E%3Cp%3EThe%20Committee%20is%20examining%20Ireland%E2%80%99s%20record%20on%20meeting%20its%20legal%20obligations%20under%20international%20human%20rights%20law.%20The%20law%20in%20question%20is%20the%20Covenant%20on%20Economic%2C%20Social%20and%20Cultural%20Rights%20ratified%20by%20Ireland%20in%201989.%20Such%20rights%20might%20well%20be%20termed%20%E2%80%9Ceveryday%E2%80%9D%20rights%20as%20they%20cover%20issues%20like%20an%20adequate%20standard%20of%20living%20%28including%20housing%2C%20food%20and%20water%29%2C%20to%20just%20and%20favourable%20conditions%20of%20work%2C%20to%20social%20welfare%2C%20to%20physical%20and%20mental%20health%2C%20to%20education%2C%20to%20a%20family%20life%20and%20to%20a%20cultural%20life.%20The%20State%20must%20ensure%20all%20people%20are%20not%20discriminated%20against%20in%20the%20enjoyment%20of%20any%20of%20these%20rights.%3C/p%3E%3Cp%3EThe%20formal%20examination%20of%20the%20Government%20will%20take%20place%20in%20Geneva%20in%20June%202015%20but%20as%20a%20first%20stage%2C%20the%20Committee%20has%20put%20a%20series%20of%20twenty-eight%20human%20rights%20questions%20%E2%80%93%20known%20as%20the%20List%20of%20Issues%20-%20to%20the%20Government.%20In%20setting%20these%20questions%2C%20the%20Committee%20has%20been%20informed%20by%20the%20Government%E2%80%99s%20own%20report%20on%20the%20years%20from%202002%20to%202010.%20However%20it%20has%20also%20received%20more%20up%20to%20date%20information%20from%20Irish%20civil%20society%2C%20including%20a%20report%20coordinated%20by%20FLAC%20with%20evidence%20supplied%20by%20more%20than%20fifty%20organisations%20and%20individuals%20around%20Ireland.%20The%20Irish%20Human%20Rights%20and%20Equality%20Commission%20has%20also%20provided%20data.%3C/p%3E%3Cp%3EThe%20Government%20now%20has%20an%20opportunity%20to%20update%20the%20information%20sought%20by%20the%20Committee%20well%20in%20advance%20of%20the%20examination%20to%20ensure%20a%20comprehensive%20understanding%20of%20how%20economic%2C%20social%20and%20cultural%20rights%20have%20been%20protected%20in%20Ireland%20over%20the%20twelve%20years%20since%20the%20last%20examination.%20%C2%A0The%20overarching%20theme%20of%20the%20UN%20Committee%E2%80%99s%20questions%20is%20how%20the%20Government%E2%80%99s%20policy%20direction%20since%20its%20last%20examination%20impacted%20on%20the%20right%20of%20people%20in%20Ireland%20to%20a%20life%20of%20dignity.%20It%20queries%20how%20the%20state%20prioritised%20the%20well-being%20of%20disadvantaged%20and%20marginalised%20in%20our%20society%20during%20what%20were%20undeniably%20tough%20economic%20times%20in%20its%20decision-making.%3C/p%3E%3Cp%3EThemes%20emerge%20in%20the%20Committee%E2%80%99s%20questions%20for%20Government%2C%20such%20as%20how%20disabled%20persons%20can%20access%20training%2C%20health%20care%2C%20community%20care%20and%20be%20safe%20from%20abuse%3B%20%C2%A0whether%20children%20are%20protected%20from%20poverty%3B%20the%20impact%20of%20cuts%20on%20hospital%20waiting%20lists%2C%20bed%20shortages%20and%20community%20care%20facilities%2C%20especially%20in%20rural%20and%20disadvantaged%20areas%3B%20whether%20fair%20wages%20can%20be%20guaranteed%20to%20people%20on%20zero-hour%20contracts%3B%20whether%20rights%20of%20minorities%20are%20protected%20in%20accessing%20public%20services%3B%20whether%20privatisation%20impacts%20on%20the%20human%20right%20of%20access%20to%20clean%20and%20affordable%20water%3B%20whether%20the%20state%20plans%20to%20provide%20social%20security%20for%20self-employed%20people%20beyond%20what%20is%20already%20available%20and%20to%20review%20its%20laws%20on%20abortion%2C%20and%20many%20others.%3C/p%3E%3Cp%3EOverall%2C%20the%20Committee%20frames%20useful%20questions%20around%20the%20adequacy%2C%20accessibility%20and%20affordability%20of%20key%20public%20services%20in%20Ireland%20over%20a%20time%20period%20spanning%20boom%20and%20bust.%20They%20will%20not%20only%20help%20the%20Committee%20in%20assessing%20the%20Government%E2%80%99s%20record%20on%20these%20rights%3B%20they%20will%20help%20us%20as%20a%20country%20to%20assess%20where%20we%20are%20and%20how%20much%20further%20we%20have%20to%20go%20to%20make%20Ireland%20a%20place%20of%20respect%20for%20every%20person%E2%80%99s%20basic%20dignity.%20The%20civil%20society%20report%2C%20%3Ci%3EOur%20Voice%2C%20Our%20Rights%3C/i%3E%2C%20%C2%A0is%20a%20kind%20of%20%E2%80%98People%E2%80%99s%20Evidence%E2%8 inputText=%3Cp%3EWhen%20FLAC%20began%20co-ordinating%20a%20report%20from%20organisations%20on%20the%20ground%20to%20present%20to%20the%20United%20Nations%20on%20the%20state%20of%20economic%2C%20social%20and%20cultural%20rights%20in%20Ireland%2C%20it%20became%20clear%20very%20quickly%20that%20housing%20would%20be%20a%20major%20issue.%20Consultations%20with%20those%20organisations%20confirmed%20that%20in%20fact%2C%20in%20Ireland%20today%2C%20people%20in%20every%20conceivable%20type%20of%20housing%2C%20as%20tenant%20or%20owner%2C%20are%20at%20risk%20of%20insecure%20housing%20or%20no%20housing%20at%20all.%20And%20too%20many%20people%20are%20homeless.%3C/p%3E%3Cp%3EThe%20evidence%20given%20by%20colleague%20organisations%20bore%20out%20what%20FLAC%20was%20already%20hearing%20from%20the%20people%20who%20phone%20our%20legal%20information%20line.%20Those%20who%20have%20recently%20contacted%20us%20have%20included%20the%20shocked%20spouse%20of%20a%20house%20owner%20who%20was%20not%20told%20by%20her%20spouse%20of%20serious%20arrears%20on%20the%20mortgage%20because%20her%20partner%20was%20trying%20to%20shield%20her%20while%20she%20dealt%20with%20her%20own%20illness%20and%20that%20of%20their%20child%20where%20the%20lender%20had%20no%20sympathy%20for%20the%20situation%20at%20all.%20They%20included%20the%20couple%20who%20had%20rented%20their%20home%20to%20tenants%20who%20would%20not%20pay%20and%20who%20now%20faced%20slow%20and%20expensive%20proceedings%20to%20implement%20a%20PRTB%20finding%20that%20they%20were%20entitled%20to%20the%20property%20back%2C%20as%20well%20as%20questions%20from%20the%20lender%20as%20to%20why%20the%20rent%20was%20not%20coming%20in.%20Troubled%20tenants%20question%20us%20about%20whether%20it%20is%20really%20legal%20to%20jack%20up%20rent%20by%20such%20a%20large%20sum%20and%20so%20quickly%2C%20leaving%20them%20without%20affordable%20accommodation.%20Our%20colleagues%20in%20other%20organisations%20told%20us%20of%20the%20frustration%20of%20those%20who%20were%20homeless%20in%20accessing%20accommodation%20and%20the%20particular%20difficulties%20of%20people%20who%20had%20any%20added%20vulnerability.%3C/p%3E%3Cp%3EAll%20of%20this%20is%20no%20longer%20news.%20The%20media%20has%20covered%20and%20continue%20to%20cover%20cases%20of%20homelessness%20and%20incipient%20homelessness.%20However%2C%20the%20purpose%20of%20this%20collated%20information%20was%20so%20that%20those%20working%20on%20the%20ground%20to%20protect%20people%E2%80%99s%20rights%20could%20inform%20an%20examination%20that%20will%20take%20place%20over%20the%20coming%20months%20of%20the%20Irish%20record%20on%20economic%20social%20and%20cultural%20rights%20by%20the%20United%20Nation%E2%80%99s%20Committee%20overseeing%20Ireland%E2%80%99s%20obligations%20to%20protect%2C%20promote%20and%20fulfil%20those%20rights.%20The%20right%20of%20everyone%20to%20an%20adequate%20standard%20of%20living%20including%20adequate%2C%20affordable%20and%20quality%20housing%20is%20one%20of%20those%20rights.%3C/p%3E%3Cp%3EThe%20last%20time%20that%20the%20Committee%20examined%20Ireland%2C%20in%202002%2C%20it%20recommended%20that%20Ireland%20address%20the%20incapacity%20of%20new%20households%20to%20access%20adequate%20and%20affordable%20housing%2C%20as%20well%20as%20the%20terrible%20situation%20of%20Travellers%20forced%20to%20live%20on%20roadsides%20without%20any%20facilities.%20That%20was%20in%20or%20about%20the%20start%20of%20the%20bubble%20which%20has%20led%20to%20much%20bigger%20problems%20since%20then.%20It%20was%20also%20a%20year%20that%20Ireland%20joined%20the%20Euro%20%E2%80%93%20and%20that%20Ireland%20drew%20in%20a%20soccer%20match%20with%20Germany.%20A%20long%2C%20long%20time%20ago%20%E2%80%93%20almost%20another%20century.%20Even%20to%20read%20the%20government%20report%20for%20this%20current%20%C2%A0examination%20tells%20us%20little.%20It%20was%20written%20some%20time%20ago%20and%20only%20brings%20the%20story%20to%202010%2C%20to%20a%20time%20that%20pre-dated%20Ireland%E2%80%99s%20acceptance%20of%20a%20bailout%20on%20terms%20that%20ultimately%20did%20terrible%20damage%20to%20the%20human%20rights%20of%20many%20people%20in%20the%20country.%20That%20report%20will%20be%20brought%20up%20to%20date%20before%20the%20full%20examination%20takes%20place.%3C/p%3E%3Cp%3EAn%20examination%20of%20Ireland%E2%80%99s%20performance%20by%20the%20UN%20in%20Geneva%20in%20Switzerland%20seems%20quite%20remote%20until%20we%20realise%20that%20it%20gives%20us%20one%20of%20the%20few%20available%20opportunities%20to%20have%20a%20thorough%20and%20wide%20ranging%20discussion%20about%20what%20is%20really%20meant%20by%20the%20solemn%20commitment%20which%20is%20legally%20binding%20on%20our%20government%20to%20protect%2C%20promote%20and%20fulfil%20rights%20to%20housing%2C%20health%2C%20education%20work%2C%20culture%20and%20more.%20These%20rights%20are%20barely%20scrutinised%20in%20our%20courts.%20There%20is%20no%20Human%20Rights%20Committee%20or%20other%20specific%20forum%20for%20discussion%20in%20the%20Oireachtas.%20There%20is%20no%20other%20%C2%A0mechanism%20at%20all%20whereby%20the%20State%20can%20be%20asked%20to%20account%20for%20how%20it%20has%20implemented%20these%20fundamental%20rights%20%E2%80%93%20a%20promise%20that%20remains%20valid%20and%20necessary%20even%20in%20a%20recession%20or%20perhaps%20particularly%20in%20a%20recession.%20So%20where%20are%20we%20to%20go%20to%20look%20at%20what%20we%20are%20doing%20to%20protect%20%C2%A0the%20right%20to%20work%3F%20How%20do%20we%20assess%20from%20the%20perspective%20of%20what%20is%20right%20what%20supports%20should%20be%20available%20to%20families%3F%20Where%20can%20we%20have%20a%20sober%20debate%20about%20matters%20from%20the%20health%20needs%20of%20older%20people%20to%20the%20deprivation%20in%20many%20areas%20of%20access%20to%20broadband%3F%20In%20fact%20we%20have%20to%20manufacture%20such%20an%20opportunity%20%E2%80%93%20and%20this%20is%20it.%3C/p%3E%3Cp%3EThe%20government%E2%80%99s%20report%20to%20the%20international%20community%20is%20also%20a%20report%20to%20us%20at%20home%2C%20telling%20us%20how%20they%20think%20they%20are%20doing%20in%20progressing%20human%20rights.%20%C2%A0The%20parallel%20report%20that%20FLAC%20launched%20on%2019%20November%20with%20its%20collaborators%20from%20the%20community%20and%20voluntary%20sector%20is%20not%20just%20our%20report%20to%20the%20UN%20body%2C%20it%20is%20also%20our%20assessment%20at%20home%20to%20our%20government%20about%20what%20we%20think%20is%20needed%20for%20a%20better%20country.%20Others%20will%20add%20their%20own%20parallel%20reports%20on%20specific%20rights%20and%20between%20them%20all%2C%20it%20is%20an%20opportunity%20to%20take%20a%20proper%20look%20at%20what%20needs%20to%20be%20done%20in%20Ireland%20in%20order%20to%20protect%20and%20promote%20some%20of%20the%20human%20rights%20that%20matter%20so%20deeply%20to%20people%20and%20that%20make%20our%20society%20a%20better%20one.%C2%A0%20It%20is%20a%20framework%20to%20identify%20what%20is%20proper%C2%A0%20and%20decent%20and%20dignified%20for%20us%20in%20Ireland.%20It%20would%20be%20good%20to%20have%20a%20better%20more%20regular%20discussion%2C%20but%20we%20must%20use%20the%20opportunity%20we%20have%20been%20given%20and%20hopefully%20all%20work%20constructively%20to%20achieve%20a%20society%20where%2C%20to%20paraphrase%20Minister%20Howlin%20on%20Budget%20Day%20last%20October%2C%20we%20don%E2%80%99t%20just%20focus%20on%20an%20economic%20recovery%20but%20also%20recognise%20the%20need%20for%20a%20social%20recovery.%3C/p%3E%3Cp%3E%C2%A0%3Ci%20style%3D%22line-height%3A%201.5em%3B%22%3ENoeline%20Blackwell%20is%20Director%20General%20of%20FLAC%20%28Free%20Legal%20Advice%20Centres%29%20a%20legal%20rights%20organisation%20which%20promotes%20equal%20access%20to%20justice.%3C/i%3E%3C/p%3E]
